There will be a public meeting of the Goffstown Zoning Board of Adjustment on Tuesday, September 7, 2010 at 7:00 p.m. in Room 107 located in the Goffstown Town Hall, 16 Main Street, Goffstown, NH 03045:

Approval of Minutes:

  1. Minutes from the August 3, 2010 meeting are available at the Zoning Department or online at http://www.goffstown.com/minutes.html.

Public Hearings:

  1. (Continued from August 3, 2010 mtg.) Brookfield Investment Group, Inc., applicant, is seeking a special exception and a variance to allow an excavation of approximately six to eight feet of material (623,048 sq. ft. of excavation area) from two adjacent properties located on Normand Road (Map 5, Lot 61-1) and Wallace Road (Map 5, Lot 95-1). The applicant is seeking a special exception authorized by Section 3.11.I.4 of the Zoning Ordinance to allow the excavation on Lot 61-1, which is located in an Agricultural District and permitted by special exception. The applicant is seeking a variance from Section 3.11.I.4 of the Zoning Ordinance because Lot 95-1 is located in a Residential-1 District where an excavation is not permitted. The property located on Wallace Road (Map 5, Lot 95-1) is in the Residential-1 District and is owned by Brookfield Investment Group, Inc. The property located on Normand Road (Map 5, Lot 61-1) is in the Agricultural District and is owned by Normand Road, LLC.
    The ZBA voted 5-0-0 at the 08/03/2010 meeting this application does not have regional impact.
    The ZBA will need to act on the written request for a continuance submitted by the applicant.
  2. (Continued from August 3, 2010 mtg.) Roland & Susan Senneville, applicants, are seeking a special exception and variance to develop a nonconforming lot and add a dwelling unit to a lot that currently has a single-family dwelling with attached accessory dwelling unit; the resulting structure will be a two-family dwelling with attached accessory dwelling unit. A special exception to develop the nonconforming lot is authorized by Section 14.7.3 of the Zoning Ordinance; the lot is nonconforming because it currently has 90ft of frontage, whereas Section 4.3 requires 100ft of frontage. A variance is required because Section 5.2 requires that accessory attached dwelling units be attached to single-family dwellings only and the proposed development will result in a two-family dwelling with an attached accessory dwelling unit. The property is located at 36 St. Anselm’s Drive (Map 13, Lot 10) in the Residential-2 District.
    The ZBA voted 5-0-0 at the 08/03/2010 meeting this application does not have regional impact.
  3. Christopher P. Tyler, applicant, is seeking a variance to allow the placement of a shed that will be setback 2ft from the side property line and 3ft from the rear property line, whereas Section 5.1 of the Goffstown Zoning Ordinance requires a 10ft setback for from side and rear property lines. The property is located at 16 Upton Lane (Map 36, Lot 62) in a Residential-1 District.
    Prior to the public hearing the ZBA needs to vote on regional impact.
  4. Ruth Williamson, applicant, is seeking a variance to allow the construction of a 3-season porch and deck that will be setback 16ft 2in from the front property line, whereas Section 4.3 of the Goffstown Zoning Ordinance requires a 25ft front yard setback. Property is located at 48 Higgins Street (Map 17, Lot 197-2) in a Residential-2 District.
    Prior to the public hearing the ZBA needs to vote on regional impact.
  5. Gregory & Alison Murray, applicants, are seeking a variance to allow the construction of a farmers porch that will be setback approximately 11ft from the front property line, whereas Section 4.3 of the Goffstown Zoning Ordinance requires a 25ft front yard setback. The property is located at 20 Heald Street (Map 14, Lot 45) in a Residential-2 District.
    Prior to the public hearing the ZBA needs to vote on regional impact.
  6. The Goffstown Planning Board is seeking an appeal from administrative classification of use made by the Zoning Code Enforcement Officer (ZCEO). On July 22, 2010 the ZCEO made the administrative classification that a Salvage Automobile Broker be classified under the category of “Sale or Rental of Motor Vehicles, Boats, Trailers, and Recreational Vehicles.” The appeal was submitted on August 19, 2010 in accordance with Section 15.3.3 of the Goffstown Zoning Ordinance.
    Prior to the public hearing the ZBA needs to vote on regional impact.
